Petition for Review
Petition for Review |
|
Filed By: Matthew Pinix
Submit Date: 9-24-2020 Decision: (D) Deny Decision Date: 1-27-2021 ORD that the petition for review is denied, without costs. BRIAN HAGEDORN, J., did not participate. REBECCA FRANK DALLET, J. (dissenting). I would grant this petition for review for two reasons. First, this case raises a significant question of whether, because of her young age, mental state, and lack of parental support, the defendant's waiver of her Miranda rights was knowing, intelligent, and voluntary. Second, as signaled by the court of appeals in footnote 8 of its opinion, the bench, bar, and public would benefit from this court's clear and definitive declaration of the appropriate standard to apply to the harmless-error analysis when a defendant has entered a plea. For these reasons, I dissent to the denial of the petition for review. I am authorized to state that Justice ANN WALSH BRADLEY joins this dissent.
