IT IS ORDERED that, within 21 days of the date of this order, each group of parties identified above shall pay to the Director of State Courts1 the amount of $21,359.67, which is one-sixth of the fees set forth in the Statement of Fees and Expenses by the Consultant Team submitted by Dr. Grofman and Dr. Cervas. Each of the parties listed in the preceding paragraph shall be responsible for the total amount of fees to be paid by the group with which they are associated. When a payment is made, the party making the payment shall file a letter with the clerk of this court stating the amount and date of the payment.
REBECCA FRANK DALLET, J. (concurring). In every case, wea court of sevenevaluate the parties submissions and arguments in good faith and render decisions that reckon with the arguments of the parties. At times we disagree, sometimes vehemently. But we remain a seven-member court even when we disagree. The majority vote rules, and the dissenting justices are welcome to voice their disagreement in separate writings.
This case is no exception. In it, we held that the 2022 state legislative district maps violated the contiguity requirements of the Wisconsin Constitution, and we enjoined their use in future elections. See Clarke v. Wisconsin Elections Commn, 2023 WI 79, 4, 410 Wis. 2d 1, 998 N.W.2d 370. We also urged the legislature and the governor to enact new maps that satisfied all the requirements of state and federal law. But, in the event they failed to do so, we set forth the process and criteria that would guide us in adopting new maps. See id., 4, 64-71.
The process we set forth was extensive, and included the following steps. All of the parties were given an opportunity to submit proposed maps, supporting briefs, and expert reports. They were then permitted to file briefs and expert reports responding to the submissions of the other parties. We appointed two independent redistricting consultants, Drs. IT IS ORDERED that the Motion for Clarification of Opinion and Order as it Relates to Recall and Special Elections is denied. On December 22, 2023, we enjoined the "Elections Commission from using [the prior] legislative maps in all future elections" because the maps violated the Wisconsin Constitution. Clarke v. WEC, 2023 WI 79, 3, 410 Wis. 2d 1, 998 N.W.2d 370. Based on the submissions before us, we decline to further clarify or amend the opinion and order.

Subsequent to our December 22 order, the Legislature enacted 2023 Wisconsin Act 94, enacting new state legislative districts maps, and the Governor signed them into law. Act 94 is not before us in the Clarke case and any examination of these maps departs from the relief requested in Clarke v. WEC. We will "not depart from our general practice that this court will not offer an advisory opinion or make a pronouncement based on hypothetical facts." State ex rel. Collison v. City of Milwaukee Bd. of Rev., 2021 WI 48, 46, 397 Wis. 2d 246, 960 N.W.2d 1. As a threshold matter, it is WEC, not this court that has the overall statutory responsibility for the administration of Wisconsins elections. Democratic Natl Committee v. Bostelmann, 488 F.Supp.3d 776, 796 (W.D. Wis. 2020) (citing Wis. Stat. 5.05(1)).

IT IS ORDERED that on or before 5:00 p.m. on Thursday, November 16, 2023, Group One and Group Two shall each submit a plan that advises the court as to the following: (1) the list of issues, in order, that the group intends to argue and the total amount of time for each issue and (2) for each issue the attorney(s) who will be arguing that issue and the amount of time that each attorney will argue. Group One may choose to reserve 15 minutes of the 80 minutes allotted oral argument time for rebuttal. The parties in each group are encouraged to reach agreement to avoid duplicating arguments. If multiple parties wish to present argument on any particular issue, those parties should ensure they will not duplicate arguments of any other party. Each group shall submit its plan to the court via email to the Clerk of Supreme Court at clerk@wicourts.gov. The subject line of the email shall read: "Urgent: Oral Argument November 21, 2023; 2023AP1399-OA;" and
