The members of the court disagree as to the disposition of the motions of defendant-appellant-petitioner, Travis Vondell Cross, for the recusal of Justice Michael J. Gableman. Justice Gableman is not participating in this order. Three Justices, Chief Justice Shirley S. Abrahamson, Justice Ann Walsh Bradley, and Justice N. Patrick Crooks, would order briefs and oral argument, as the parties have requested, including among the issues to be briefed and argued the defendant-appellant-petitioner's right to appeal under Wis. Const. Art. I, sec. 21. Three Justices, Justice David T. Prosser, Justice Patience Drake Roggensack, and Justice Annette Kingsland Ziegler, would issue an order denying the motions. The parties are referred to the court's order of February 11, 2010, in State v. Allen, No. 2007AP795, 2010 WI 10, ___ Wis. 2d ___, ___ N.W.2d ___, 2010 WL 457545, for the justices' writings in explanation. Because the members of the court disagree as to the disposition of defendant-appellant-petitioner's motions as set forth above, the motions are not granted.
